Electronic Signature Consent

Consent to Use Electronic Communication and Signature

This Electronic Communications Agreement (“Disclosure”) applies to all communications related to the prepaid card account and the secured card account (“Credit Sesame Accounts”) and accompanying services available through creditsesame.com (the “Website”) and mobile application (“Credit Sesame Mobile App”). This Disclosure supplements and is to be construed in accordance with the terms contained in the Cardholder Agreements, the accompanying the Terms of Service and the accompanying Privacy Policies you received when you obtained the Credit Sesame Accounts.

“We”, “us”, “our”, refers to Credit Sesame, Inc. (the “Program Manager”) and the Community Federal Saving Bank (the “Issuing Bank”). “You” and “your” mean the person or persons identified on the Credit Sesame Account(s). “Communication” means any customer agreements or amendments thereto, disclosures, notices, responses to claims, transaction histories, privacy policies and all other information in connection with the Credit Sesame Account(s) or related products and service, including but not limited to information that we are required by law to provide you in writing.

The Credit Sesame Account(s) is intended for use only by person(s) who are willing and able to receive notices and communications exclusively through the Website, the Credit Sesame Mobile App or via electronic mail (“E-mail”). If you do not agree to the legally-required notices and communications described herein in electronic and not paper form, you may not open a Credit Sesame Account(s). Similarly, if after providing your consent hereunder, you withdraw such consent, your Credit Sesame Account(s) will be closed.

1. Scope of Consent.

Your consent applies to any Communications we provide to you or that you sign or agree to or submit at our request in connection with the Credit Sesame Account(s), to the extent allowed by law. Your consent to receive electronic communications and transactions includes, but is not limited to:

  • All legal and regulatory disclosures and communications associated with your Credit Sesame Account(s), including e-statements or other periodic statements
  • Change-in-terms related to your Credit Sesame Account(s);
  • Privacy policies and notices;
  • Responses to claims filed in connection with your Credit Sesame Account(s);
  • Notices regarding insufficient funds or negative balances; and
  • All other communications between us and you concerning your Credit Sesame Account(s) and any related transactions, products or services.
2. Method of Providing Communications.

Communications that we provide to you in electronic form will be provided either through the Website, the Credit Sesame Mobile App or via E-mail. Periodic statements will be made available via the Credit Sesame Mobile App or the Website. Please log into your Credit Sesame Account, and click on the “Statements” tab. You may receive a notification when your periodic statement is available to be viewed. You are responsible to review and retrieve the periodic statement(s).

3. How to Withdraw your Consent.

You may exercise your right to withdraw your consent to receive communications in electronic form by contacting us at 444 Castro St., Ste 500, Mountain View, CA 94041. You may upon request obtain a paper copy of any electronic record referred to in Section 1 at no charge. If you withdraw your consent, we will be required to close your Credit Sesame Account(s) in accordance with the account closure process within the respective Terms of Service or Cardholder Agreement. If you withdraw your consent, the legal validity and enforceability of prior Communications delivered in electronic form will not be affected

4. How to Update your records.

It is your responsibility to provide us with true, accurate and complete contact information including email address, phone number, and other information related to this Disclosure and your Credit Sesame Account(s), and to maintain and update promptly any changes in this information. You can update information (such as your email address) through creditsesame.com, the Credit Sesame Mobile App, or by contacting us at (877) 751-1859. We are not responsible for any delay or failure in your receipt of the communications if we send the communications to the last email address you have provided to us or if you are unable to access your Credit Sesame Mobile App.

5. System Requirements.

In order to access, view, and retain electronic communications that we make available to you, you must have

  • an active e-mail address;
  • a Current Version (defined below) of the Credit Sesame Mobile App;
  • a Current Version of an Internet browser we support;
  • a connection to the Internet;
  • a Current Version of a program that accurately reads and displays PDF files; and
  • a computer and an operating system capable of supporting all of the above.

You will also need a printer if you wish to print and retain records on paper, and electronic storage if you wish to retain records in electronic form.

By “Current Version,” we mean a version of the software application that is currently being supported by its publisher. From time to time, we may offer services or features that require that your computer or software applications be configured in a particular way. If we detect that your computer or software applications are not properly configured, we may provide you with a notice and advice on how to update your configuration. We reserve the right to discontinue support of a Current Version of a software application if, in our sole opinion, it suffers from a security flaw or other flaw that makes it unsuitable for use.

If our hardware or software application requirements change, and that change would create a material risk that you would not be able to access or retain electronic communications, we will give you notice of the revised requirements. Continuing to use electronic communications and/or the Credit Sesame Account(s) after receiving notice of the change is reaffirmation of your consent.

6. Federal Law.

You acknowledge and agree that your consent to electronic communications is being provided in connection with a transaction affecting interstate commerce that is subject to federal Electronic Signatures in Global and National Commerce Act (the “Act”), and that you and we both intend that the Act apply to the fullest extent possible to validate our ability to conduct business with you by electronic means.

7. Termination/Changes.

We reserve the right, at our sole discretion, to discontinue the provision of your electronic communications, or to terminate or change the terms and conditions on which we provide electronic communications. We will provide you with notice of any such termination or change as required by law.

8. Consent.

By checking the box and clicking “Next”, you adopt the check as your electronic signature and you give your affirmative consent to provide electronic communications to you as described herein. You further agree that your computer satisfies the hardware and software requirements specified above and that you have provided us with a current e-mail address at which we may send electronic communications to you.
