Cash Back Offers Program Privacy Policy  

    1. “Offer” is the cash-back credit, discount, or other reward offer provided by the Merchant or Credit Sesame that is available through the Cash Back Offers program on the Site.
    2. “Site” means Credit Sesame’s websites and mobile applications that link or reference the Cash Back Offers program.
    3. “Merchant” means any participating merchant that makes an Offer available to you through the Site.
    4. “Third-Party Service Providers” means third parties, including Empyr, Inc. (“Empyr”,) that allow us to present Offers in the Sesame Cash Rewards program.
    5. “Enrolled Card” means the Sesame Cash card linked to the Sesame Cash Rewards program.
    6. “Qualified Purchase” means a purchase made from a Merchant with an Enrolled Card that has been processed as “credit,” made in compliance with these terms, and tracked by this program.
  1. Use of Transaction Data. Notwithstanding anything to the contrary in the Credit Sesame Terms of Use or Privacy Policy, Credit Sesame and its Third-Party Service Providers, including Empyr, will use transaction data as follows:
    1. To confirm a Qualifying Purchase or to match transactions to confirm whether you qualify for an Offer;
    2. To share with the Merchant where a transaction occurred as needed for the Merchant to confirm a specific transaction occurred or points should be awarded. For example, the date and amount of your purchase and the last 4 digits of your card number so the Merchant can verify your purchase with its records if there is a missing or disputed transaction;
    3. To provide Merchants or Third-Party Service Providers aggregated and anonymized information relating specifically to your Enrolled Card activity to allow Merchants and Third-Party Service Providers to assess the results of their campaign;
    4. To create a record and thereafter maintain and use data in connection with operating the Cash Back Offers program;
    5. To conduct analysis for the improvement and optimization of the Cash Back Offers program; and
    6. To provide information in order to respond to a request from government authority or a payment organization involved in a transaction with you or a Merchant.

You authorize the sharing, exchange and use of transaction data described above and herein by and among Credit Sesame and its Third-Party Service Providers including Empyr, MasterCard, and applicable Merchants.

If you have consented to participate in the Cash Back Offers program, please visit the terms to learn more about the data collection, use, and sharing practices in connection with the program. If you would like to opt out of card linking and transaction monitoring in connection with the program, please see below.
  2. How to Opt-Out of the Cash Back Offers To opt-out of our program and unlink your card, you must follow the steps below:
    1. In the “Cash” tab of the Credit Sesame app, select the settings icon
    2. Select “Cash Back Offers”
    3. Select “Opt Out of Cash Back Offers”
    4. Confirm opt-out request by selecting “Unlink”
    5. You will receive confirmation that your card has been unlinked from Cash Back Offers

Cash Back Offers Program Terms and Conditions

The Cash Back Offers program allows you to receive cash-back credits, discounts, and other rewards when you use an Enrolled Card to make a Qualified Purchase from a Merchant.

By enrolling in the Cash Back Offers program, you consent to the monitoring, sharing, exchanging, and using of transaction data as described in the Cash Back Offers Privacy Policy by and between Credit Sesame, Third-Party Service Providers such as Empyr, and each Merchant, together with Credit Sesame’s Terms of Use and Privacy Policy.

  1. Definitions. 
    1. “Offer” is the cash-back credit, discount, or other reward offer provided by the Merchant or Credit Sesame that is available through the Sesame Cash Rewards program on the Site.
    2. “Site” means Credit Sesame’s websites and mobile applications that link or reference the Sesame Cash Rewards program.
    3. “Merchant” means any participating merchant that makes an Offer available to you through the Site.
    4. “Third-Party Service Providers” means third parties, including Empyr, Inc. (“Empyr”,) that allow us to present Offers in the Cash Back Offers program.
    5. “Enrolled Card” means the Sesame Cash card linked to the Cash Back Offers program.
    6. “Qualified Purchase” means a purchase made from a Merchant with an Enrolled Card that has been processed as “credit,” made in compliance with these terms, and tracked by this program.
  1. Transaction Monitoring. By registering a payment card in connection with transaction monitoring (i.e., Enrolled Card), you authorize Credit Sesame, and its Third-Party Service Providers, including Empyr to share your payment card information with MasterCard. You additionally authorize MasterCard to monitor transactions on your Enrolled Card(s) to identify Qualifying Purchases in order to determine whether you have qualified for or earned an Offer linked to your Enrolled Card, and for MasterCard to share such transaction details with you, Credit Sesame, and its Third-Party Service Providers to enable your card-linked Offer(s) and target Offers that may be of interest to you. You may opt-out of transaction monitoring on the Enrolled Card(s) you have registered by following the instructions below.

  1. Card Eligibility. The payment card network participating in the Cash Back Offers program is MasterCard. Not all MasterCard cards are eligible for enrollment.
  1. Transaction Eligibility. Not all transactions with your Enrolled Card are tracked by MasterCard. There is a $250 Merchant cash-back limit per transaction.

You acknowledge that MasterCard may be unable to monitor every transaction made with your Enrolled Card, including PIN-based purchases, purchases you initiate through identification technology that substitutes for a PIN, payments made through other payment methods (such as a digital wallet or a third party payment app, where you may choose your MasterCard card as a funding source but you do not present your card directly to the Merchant), payments of existing balances, balance transfers, or transactions that are not processed or submitted through the MasterCard payment system, and that these transactions are not eligible.

  1. Debit Clarification. Because your Enrolled Card is a MasterCard debit card, your transactions must be processed as a “credit” transaction to make sure the transaction can be monitored. Do not use a Personal Identification Number (PIN) when paying for your purchases with your Enrolled Card if you want the transaction to be eligible for Offers.
  1. Double Enrollment Restrictions. We use Empyr to help us operate our program. Your payment card may only be enrolled in one program operated by Empyr. If you have already enrolled a payment card with a separate program operated by Empyr, you will be unable to register that card in both Empyr-operated programs. You may unlink your payment card in the other Empyr-operated program should you wish to enroll that card in the Cash Back Offers program.
  1. Cash-Back Credits. Cash-back credits should appear or be reflected on your Sesame Cash transaction log within 24 hours from the time of purchase but may be subject to delays. Cash-back credits may be negative if a refund is processed on a Qualifying Purchase. Qualifying Purchase transactions must be posted by MasterCard within seven days or cash-back credits earned for the transaction will be reversed and reflected as a negative credit.
  1.  Sesame Cash Account Requirement. You must maintain an active Sesame Cash account in order to be eligible for Offers with your Enrolled Card. If you freeze your Enrolled Card, opt-out of the program, or close your Sesame Cash account, you will forfeit any pending Offers.
  1. Release of Liability. TO THE FULLEST EXTENT PERMISSIBLE PURSUANT TO APPLICABLE LAW, CREDIT SESAME AND ITS AFFILIATES, LICENSORS AND SUPPLIERS (INCLUDING MASTERCARD AND MASTERCARD PROCESSORS) EXPRESSLY DISCLAIM ANY WARRANTIES, EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR ANY PARTICULAR PURPOSE, AND NON-INFRINGEMENT. CREDIT SESAME AND ITS AFFILIATES, LICENSORS AND SUPPLIERS (INCLUDING MASTERCARD AND MASTERCARD PROCESSORS) DO NOT WARRANT THE DATA, CONTENT, ANALYTICS, FEATURES, OR INFORMATION PROVIDED THROUGH THE PROGRAM, INCLUDING WITHOUT LIMITATION TRANSACTION DATA OR USER SUBMISSIONS OR OTHER DATA PROVIDED BY OTHER USERS, TO BE UNINTERRUPTED, ACCURATE, USEFUL, OR FREE OF ERRORS, VIRUSES, OR OTHER HARMFUL COMPONENTS.

UNDER NO CIRCUMSTANCES WILL CREDIT SESAME OR ITS AFFILIATES, CONTRACTORS, EMPLOYEES, AGENTS, OR THIRD PARTY PARTNERS OR SUPPLIERS (INCLUDING MASTERCARD OR MASTERCARD PROCESSORS) BE LIABLE FOR ANY SPECIAL, INDIRECT, INCIDENTAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING OR RELATED TO THE PROGRAM, EVEN IF PROGRAM HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT WILL CREDIT SESAME’S OR ITS AFFILIATES’, CONTRACTORS’, EMPLOYEES’, AGENTS’, OR THIRD PARTY PARTNERS’ OR SUPPLIERS’ (INCLUDING MASTERCARD’S AND MASTERCARD PROCESSORS’) TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE PROGRAM (WHETHER IN CONTRACT, TORT INCLUDING NEGLIGENCE, WARRANTY, OR OTHERWISE) EXCEED THE LESSER OF YOUR LIFETIME CASH BACK OFFERS PROGRAM OFFER SAVINGS OR $250.00.
